Referral Program Terms

The referral program pays you for introducing a homeowner to HVACandRoof. You are not a contractor, employee or agent of HVAC and Roof Corp, and nothing in this program creates an employment, partnership, joint venture or franchise relationship.
Your commission is paid out of the fee we charge a contractor on a completed job. It is never added to what the homeowner pays, and the homeowner is never charged for using the marketplace at all.
What you earn
20% of our fee on a qualifying job — not 20% of the job. Our own fee is charged on the job’s Standard Labor Value only — 15% of the first $999 of labor and 12% of the labor above it, never on materials, permits or tax — and it is published in full on the contractor program terms page. Your commission moves with that fee: a job whose price is mostly equipment carries a smaller fee, and therefore a smaller commission, than its headline price suggests.
We charge no fee on a deposit — the whole fee lands on the final invoice — so a commission follows the final invoice too. We charge ourselves no fee on work HVAC and Roof Corp performs itself, and a job we perform therefore earns no commission: there is no fee for a share to be taken of. A job with little or no labor — equipment supplied and installed by the homeowner, say — earns little or no commission, for the same reason.
We make no claim, projection or guarantee about how much anyone earns. Most referrals never become paid jobs.
What earns a commission
A completed, paid job — nothing earlier
All of the following must be true before anything is owed to you:
- a homeowner reached us through your link, QR code or tracking number;
- the request was credited to you under the attribution rules below;
- the request was qualified — real, in an area we serve, not a duplicate;
- a contractor we matched completed the work and was paid; and
- the contractor’s fee to us was charged and not reversed.
A click, a call, a submitted request or a quote earns nothing. Requests are matched to at most 3 independent contractors, who decide whether to quote; we do not control whether a homeowner hires.
Credit goes to the first introduction
Attribution is first touch inside a 90-day window measured back from when the homeowner submits their request. If two partners touched the same homeowner in that window, the earlier introduction is credited — a later click never takes credit from the partner who actually made the introduction.
Touches are your referral link, your QR code, a call to your tracking number, and your code carried through the request form. Nothing else is tracked: referral clicks are stored with a hashed IP for duplicate detection and no cross-site identifier, and we do not fingerprint visitors to extend attribution further.
What is excluded automatically
- Self-referral — a request from the account you sign in with, or for a property you own or control.
- Duplicates — a request from a homeowner already credited to another partner inside the window.
- Repeat callers — a further request from the same phone number or property already in the system.
Excluded requests still go to contractors and the homeowner is still served; they simply earn no commission. Some exclusions are flagged for a person to review rather than decided automatically.
When you are paid
Earned, then held, then payable
A commission is earned when the job is complete and the qualifying payment has cleared. It is then held for 30 days against refunds and chargebacks before becoming payable. Your portal shows each commission, its current state, and the reason whenever it is not yet payable.
Paid by one company, in batches
HVAC and Roof Corp owes and pays every commission earned in this program, in payout batches, and records the payment reference from its own bank or payment system. Money is never netted between businesses: a commission owed by another company in the partner network is that company’s to pay, on its own terms.
You are responsible for your own taxes. Payments are reported per paying company per calendar year, and we may require tax details before a payout can be released.
Reversals and clawbacks
A refund, chargeback, cancellation or fraud finding reverses a commission — before or after payment. A reversal after payment is recovered from later commissions or invoiced to you. The ledger records reversals; it never deletes the history.
What partners must not do
No unsolicited bulk messaging
Referrals must be genuine introductions to people who want them. No purchased lists, no unsolicited bulk email, calls or texts, and no automated messaging. You are responsible for your own compliance with the TCPA, state calling and texting rules and Do-Not-Call requirements.
No speaking for the marketplace or a contractor
Do not present yourself as HVACandRoof, as a contractor, or as authorised to quote, price, schedule or promise anything about the work. Do not create accounts, sites, profiles or ads that appear to be ours. Selling or negotiating home-improvement work on a contractor’s behalf is separately regulated in several states — this program is an introduction, not that.
No misleading incentives
You may tell people you earn a commission — we would rather you did. You may not claim the marketplace is free because of you, offer a rebate contingent on the homeowner hiring, or promise pricing, timelines or outcomes on a contractor’s behalf.
Where we do not run the program
Some states and municipalities restrict paying for referrals of home-improvement or contracting work. Where that is the case we do not operate the program, and an application or a commission may be declined on that basis.
Approval, changes and ending
Applications are reviewed by a person and may be declined. An account may be paused or closed for the conduct above, for suspected fraud, or at your request. Commissions already payable when an account closes are still paid; pending ones are decided under these terms.
We may change the commission rate, the attribution window or the hold period. A change applies to referrals made after it takes effect, never retroactively to commissions already earned.
This page is a summary, not the contract

The version recorded against your acceptance is shown at the top of this page — while it reads draft-unreviewed, these terms have not completed legal review, and partners on that version will be told when a reviewed version replaces it.
